Grand jury declines to indict Garrett Cross

MONTGOMERY COUNTY, Texas – The case against a former middle school educator accused of indecency with a child in Montgomery County has been dismissed.

The Montgomery County District Attorney’s Office confirmed on Thursday, Aug. 13 that a grand jury returned a no-bill against Garrett Cross.

Cross’s attorney said the grand jury did not return an indictment because of a lack of probable cause. Cross’s family also says he was on paternity leave and was not on campus on the date of the alleged incident.

What happened

The Montgomery County Sheriff’s Office said it obtained an arrest warrant May 7 for Cross after investigators looked into allegations from the period when Cross worked at Pine Valley Middle School in New Caney ISD.

Cross turned himself in to the sheriff’s office May 8.
