washingtonpost.com‘I think it’s about time’: Bars, restaurants eager to get back to business as state lifts capacity limits, mask mandate
HOUSTON – With several state COVID-19 restrictions ending in Texas on Wednesday, a Houston bar is planning to reopen for the first time in months. “Employees are going to wear masks. Greg Abbott is lifting the state’s mask mandate and allowing any business to open at 100% capacity. The bar plans to provide sanitation stations and will require employees to wear masks, but customers can choose whether to cover their face, he said. Guidelines from the Texas Restaurant Association call for employees to wear masks while working, while customers are encouraged to wear masks.
Ask 2: Will restaurants still require customers, employees to wear masks?
Private businesses and entities have the legal right to require customers and employees to wear a mask. AdGuests and employees have no “constitutional free speech rights in a private business or workspace,” according to restaurant.org. The First Amendment of the U.S. Constitution protects an individual’s right to free speech from infringement by the government, but not a private business. He said the department is not interested in arresting people and he urged residents to either wear a mask or take their business elsewhere. “If you go to a business and they tell you to wear a mask, please either wear the mask or decide to take your business elsewhere.

Abbott explained that a business is not mandated to reopen at 100%, but now it is the restaurant owner’s choice.
