Man faces capital murder charges after fatal stabbing outside Galleria

HOUSTON – A man has been arrested and charged with capital murder after he stabbed a man to death outside Neiman Marcus at the Galleria, according to police.

A shopper captured the aftermath of the attack with a cellphone.

HPD homicide investigators said they have evidence to believe Andre Roy, 35, was attempting a robbery when he committed the crime, but nothing appeared to be taken from the victim.

"I really feel unsafe everywhere. You really have to just watch your surroundings everywhere around here," shopper Breanda Evans said. "You would think this is a safe place."

Roy has an extensive criminal history. His most serious charge, so far, is capital murder.

The stabbing was reported Thursday just after 9 p.m. on Post Oak and Westheimer.

Authorities said 61-year-old Franklin Medina exchanged words with Roy and then Roy stabbed Medina multiple times. He was taken to Ben Taub Hospital, where he died. 

"His body was just there. He wasn't even moving. He was just laying there," witness Edith Erazo said. 

Another witness held Roy until police officers arrived and arrested him.

Roy has a lengthy criminal history that dates back to 2000. It includes charges for deadly conduct, unlawful carrying of a weapon, and possession of marijuana. He now faces a capital murder charge.

"I guess at first he was screaming, like why are you doing this to me, to the cops, and then they just arrested him, and he was just there sitting down," Erazo said.

Channel 2 was told the Galleria does have surveillance video of the attack.
