Man arrested, charged in taco truck owner’s fatal shooting near Gulf Freeway

HOUSTON – A man has been arrested for shooting and killing the owner of a taco truck near the Gulf Freeway earlier this month, the Houston Police Department said.

Jimmie Wayne Daniels, 21, was charged with capital murder in the 487th State District Court. He is accused of killing 29-year-old Roberto Almaguer Garza.

HPD patrol officers responded to reports of a shooting at a gas station located in the 8500 block of the Gulf Freeway at around 3:45 a.m.

Police said when they arrived, they found Garza with multiple gunshot wounds. Houston Fire Department paramedics pronounced the victim dead.

Investigators determined that Garza was the owner of the food truck and a man attempted to rob him at gunpoint. During the robbery, a scuffle ensued, during which the victim was shot multiple times. The suspect fled the scene on foot in an unknown direction, HPD said.

Further investigation reportedly identified Daniels, who was already in custody for unrelated felony incidents, as the suspect in the shooting. He was charged for his alleged role in the fatal shooting on Thursday.

Daniels has an extensive criminal history that began in 2014. He has been jailed for aggravated robbery with a deadly weapon in the past.
