A lawsuit has been filed a day after the deadly fire at the Marathon Petroleum refinery in Texas City.

Scott Higgins, 55, of Deer Park, Texas was identified as the victim. On Tuesday, another worker, who said he suffered second- and-third degree burns in the fire filed a lawsuit against the Marathon Petroleum refinery.

Benzene is a known human carcinogen, according to the EPA. The Texas refineries were among a dozen industrial plants in the U.S. that emitted the highest levels of the chemical in 2021.

A crude oil leak at the Marathon Petroleum ‘s Galveston Bay refinery in Texas City prompted road closures in the area Wednesday, officials said.
