Burke was charged and arrested for the death of 14-year-old Celeste Rivas.

Prosecutors said Burke killed Rivas on or about April 23, 2025.

The complaint states the killing was intentional and carried out with “malice aforethought.”

It also alleges several aggravating circumstances that could increase penalties if proven in court.

Those include claims that the killing was:

  • Committed for financial gain
  • Carried out by lying in wait
  • Done to silence a witness to a crime

Under California law, those factors can elevate the severity of the charge and potential punishment.

Los Angeles County District Attorney Nathan Hochman said prosecutors are looking to enhance charges based on these claims, in a press conference on Monday.

The complaint alleges that between September 2023 and September 2024, Burke engaged in three or more acts of sexual conduct and lewd acts involving the child.

It further states that Burke resided with or had recurring access to the victim, a key element in continuous abuse charges.

If convicted, the charge would require mandatory sex offender registration and carries the possibility of a lengthy prison sentence.

Accused of mutilating remains

A third charge alleges Burke mutilated the victim’s remains on or about May 5, 2025.

Prosecutors also allege he used a sharp instrument, which is considered a deadly weapon, in committing that act.

No bail recommended

Court records show Burke is currently in custody, with prosecutors recommending no bail.

The case was investigated by the Los Angeles Police Department’s Robbery-Homicide Division.

If convicted on the charges, Burke faces significant prison time, including the possibility of death penalty.

Burke has not yet been indicted by a grand jury.

Attorney Kent Schaeffer, representing Burke’s family, sent the following statement:

“The Burkes are not surprised but are terribly disappointed that the District Attorney chose to charge David. Nevertheless they support and stand by him one hundred percent.”

According to court documents, Burke was the target of a grand jury investigation in February and his family members were called to testify but they were fighting it in Texas Supreme Court.

Defense attorneys Blair Berk, Marilyn Bednarski and Regina Peter stressed that Burke has only been detained under suspicion and they plan to vigorously defend his innocence.

A court date has been set for Thursday.
