Police say a red Toyota, driven by 34-year-old Nicholas Vivier of League City, was traveling northbound when it crossed the grassy median and collided with a white 2025 GMC truck traveling southbound. The GMC truck was driven by a 77-year-old man from Lake Jackson and had a 71-year-old female passenger also from Lake Jackson.

Vivier and the occupants of the truck were transported CHI St. Luke’s Emergency Room. Vivier and the 77-year-old man were treated for non-life-threatening injuries. The woman had serious injuries and was later transferred to Memorial Hermann Hospital in Houston. Her condition is unknown at this time.

“The investigation determined that Nicholas Vivier intentionally crossed the grassy median to cause a crash. After being released from the hospital, he was transported to the Brazoria County Jail and charged with two counts of Aggravated Assault with a Deadly Weapon,” the City of Lake Jackson said in a release.

Both the northbound and southbound lanes of Highway 288 were closed for approximately two and a half hours while officers worked on the crash scene.

The incident remains under investigation.
