Court records identified the victim as Fernando Gallardo.
Gracia allegedly shot and killed Gallardo during an attempted robbery at the Daze Elevated smoke shop at 8650 North Houston Rosslyn Road.
On Saturday, an employee who was driving by told Houston police they saw the “open” sign turned on outside business hours, and Gallardo’s car was nowhere to be seen. When the employee went to check the business, they found the owner dead in the back.
Officers eventually located the missing vehicle and conducted a felony stop. They detained the driver, who they said matched the description of a person seen on surveillance video.
Court records show Gracia is scheduled to appear in court on Feb. 16.
