MAGNOLIA, Texas – Investigators are looking into a deadly shooting in Magnolia where a retired officer and off-duty officer, both with Houston PD, shot a man threatening a homeowner.

The shooting happened around 11:15 p.m. at a home on Knotty Oaks off Walnut Creek. An unidentified man showed up unannounced and refused to leave.
“Feeling threatened, the homeowner contacted her father and a neighbor for help,” Montgomery Co. deputies shared in a news release.

The homeowner’s father is actually a retired officer with HPD and her neighbor is an active member with HPD but was off-duty at the time. It’s unclear what happened when they both got to the scene, but Montgomery Co. deputies said both men shot the trespasser “due to the ongoing threats.”
Responding deputies, as well as the homeowner, treated the man’s injuries before he was rushed to the hospital, where at last check he was receiving treatments but expected to survive.

The off-duty officer, later identified as M. Malthaus, a 9-year veteran with HPD assigned to the homicide division. Per protocol, he will be placed on administrative leave as the Montgomery Co. Sheriff’s Office takes the lead on the investigation.
Montgomery Co. Sheriff Wesley Doolittle meanwhile, shared a statement on social media noting what happened. Sheriff Dolittle also confirmed he and HPD Chief Noe Diaz arrived at the scene, where they were fully briefed, and that charges are being filed against the “prowler” at the retired HPD officer’s daughter’s home. Here’s his complete statement:
“I am grateful for the diligent efforts of our Deputy’s, who work tirelessly day in and day out. Last night, an off-duty Houston Police Officer and a Retired Houston Police Officer were involved in a use of force incident at the retired officer’s daughter’s residence. The daughter, who lives nearby her father and next door to the Houston Police Officer, observed a prowler at the back door of her home and contacted her father for assistance. Upon arrival, the two officers confronted the trespasser, resulting in the suspect being shot multiple times. The suspect was transported to Memorial Hermann Hospital and is expected to survive. The Montgomery County Sheriff’s Office, the Houston Police Department, and the Montgomery County District Attorney’s Office are conducting an investigation into this shooting incident. Houston Police Chief Noe Diaz and I both made the scene.”
