Rivera is accused of killing 12-year-old Carlos Fernandez on March 4.

Carlos was sleeping in his Cloverleaf home when police say Rivera, his mother’s ex-boyfriend shot into the child’s bedroom, killing him as he tried to protect his younger sisters.

Carlos’ family told KPRC 2′s Corley Peel they are relieved he’s been arrested.

“God is so great,” Carlos’ aunt said. “Justice will now be done.

Carlos’ mother, Ashley Rostro spoke out last week saying she shares her two young daughters with Rivera.

“He’s just a jealous guy,” Rostro said.

Rostro also said she called 9-1-1 the Friday before the shooting when Rivera showed up at her apartment.

“When he got here, he had my gun,” Rostro said. “I’m trying to stop him from coming in the apartment, and he just grabs me and pushes me.”

Rivera was gone before deputies arrived. The District Attorney’s office said Rostro was not hurt and the deputy did not report a gun used in the attack. The DA declined charges. However, Sheriff Ed Gonzalez said in a news conference Friday that the sheriff’s office notified the DA.

Carlos’ family members told Peel they are relieved Rivera has been caught and are confident justice will be done.

The fugitive’s arrest comes on the same day that Carlos’ family laid the boy to rest.
