CONROE, Texas – The Conroe Municipal Court Judge, William Waggoner, facing charges for driving while under the influence and unlawful carrying of a weapon was disciplined in the military for DUI, according to new court documents obtained by KPRC 2.
Judge Waggoner was arrested last week in Montgomery after investigators said his vehicle was driving 61 miles per hour in a 35 mile per hour zone.

An arrest affidavit KPRC 2 obtained this week states the officer noticed a strong smell of alcohol, glassy and bloodshot eyes, slurred speech and that Waggoner was unsteady on his feet.
Waggoner also told the officer to “be aware that he is a judge,” according to the document.
Waggoner admitted he had been driving, but denied drinking, according to court records. Officers asked him to do standardized field sobriety tests, but documents say he refused to complete the walk-and-turn and one-leg stand tests. He also refused chemical tests, including breath, blood and urine.
A judge signed off on a forcible blood draw. The results of the blood draw were not included in the court documents.
KPRC 2 has learned Waggoner has been arrested several times in the past.
The first dates back to 2008 for an evading arrest charge. Court documents state he completed a diversion program to get the charge dismissed.
Then in 2014, he was arrested for DWI. But the assistant district attorney at the time dismissed the charge citing “insufficient evidence.”
Most recently in 2017, he was arrested for DWI in San Antonio. Court records show he took a plea deal, got the crime down to a lesser charge and completed court orders to avoid conviction. The charge was dismissed.
Last week, a city spokesperson sent KPRC 2 the following statement:
“The City is aware that our Municipal Judge, Will Waggoner, was arrested early this morning for a possible DWI and UCW. No one is above the law, or immune from making mistakes. It is an unfortunate incident and as with any arrest, one is not guilty until proven so. Judge Waggoner is an elected official and he is still the sitting Municipal Judge. We will not comment on the facts of the case.”
Waggoner is running for Justice of the Peace in Montgomery County’s Precinct One. KPRC 2 has reached out to Waggoner several times and we are waiting to hear back.
