Prosecutors say, McIntyre was shot in the arm by someone fleeing the party, “People were taking cover downstairs, and trying to get out of the house,” said Jamie Burro, Assistant District attorney, homicide division. She added, “My understanding is that he was the only one in the house doing the shooting. There may have been people outside defending themselves that shot back into the house.” Burros explained it was an active shooter situation, people were fleeing for their lives.

The prosecutor said that detectives found him in the house, holding a gun with a green laser on it.

In court, the prosecutor did not ask for any bond. “He’s very dangerous and we hope he stays in the Harris County jail until trial,” said Burro. She added, “Someone who will go into a party and just start shooting is somebody we can’t have in society.”

McIntryre was brought in for probable cause and to be given his warnings. He had a court appointed attorney with him in court, however he told the judge he wants to hire his own attorney.

McIntyre is charged with capital murder. The prosecutor explained to journalists outside the courtroom that, “we only allege two victims at this time. We may change that when we take it to a grand jury, but we do believe he killed three people, but it doesn’t increase the charge in anyway.”

Up next, both sides will compile their evidence and proceed toward a trial. The process often takes a couple of years.
