Ask 2: Who’s responsible for driveway-related accidents?

At KPRC 2, we’re dedicated to keeping Houstonians informed. As part of our Ask 2 series, the newsroom will answer your questions about all things Houston.


HOUSTONAsk 2: “I parked in front of my uncle’s driveway and his neighbor across the street backed out of their driveway and hit my car. Is he responsible?”

Answer: Yes, your Uncle’s neighbor is responsible especially if you were parked legally.

Sgt. Stephen Woodard with the Texas Department of Public Safety also agrees. Here is what he had to say:

“It is the operator’s responsibility to make sure they back the vehicle safely. So, even if they are backing out of a private driveway onto a main portion of the traveled roadway, if your vehicle is parked legally and that individual backs into your vehicle, they are liable all day every day,”  stated Sgt. Woodard.
