Man cleared in Haverstock Hill shooting being held on unrelated theft charge

HOUSTON – A man mistakenly charged with capital murder in connection to a shooting at the Haverstock Hill Apartments that killed two and wounded four is still behind bars.

He's wanted for a crime in a neighboring county.

Jeremy Jones and his brother, Harvey, were arrested in connection with the mass shooting.

Prosecutors dropped the capital-murder charges against Jeremy on Thursday, calling it a case of mistaken identity.

Authorities said even though Jeremy is not facing charges in Harris County, he remains in the county jail because he's pending a transfer to Brazoria County.

Brazoria County authorities said Jeremy will be held in their jail for a theft charge, which is unrelated to the Sunday shooting.

Investigators said they are still looking for the second person believed to be involved in the shooting. His brother, Harvey, was expected to appear in court Friday. He's still charged with aggravated assault with a deadly weapon.

Harris County deputies said two people pulled up to the apartment complex in a vehicle Sunday evening. They said the pair got out of the vehicle and one of them grabbed a gun. They said the other one began shooting the gun. The shooting, which police said stemmed from an earlier argument, killed Wayne Rushner, 31, and Christopher Beatty, 32. Two other men and two women were injured.

"I'm not coping with it; since this has happened, I haven't slept," said Beatty's father, who didn't want to release his name.

His other son, Arthur Larkin, also known as "Lee Lee," is still in a hospital recovering from a gunshot wound to his side, which went into his intestines.

The father said he witnessed the entire shooting.

He was sitting outside on the first floor porch March 26 when he said an altercation erupted on the staircase.

Beatty, his brother Arthur, their close friend Wayne Rusher and his siblings Isaiah and Brandy Rusher were sitting on the bottom steps hanging out.

"They were sitting on the steps, that's all it was about, then she started cussing at them to get off her steps," explained Beatty's father.

He said the upstairs neighbor was upset they were sitting there and she called some friends. Witnesses say that's when a white car rolled up with two men and a woman inside.

"I was sitting right there, that's when I heard the woman say she was a police officer," said Beatty's father, who added that he doesn't know if that was true.

Video captured by a neighbor shows the verbal fight in the street.

Moments later, multiple gunshots were heard in rapid succession, which authorities later said was a high powered assault rifle.

"Chris got shot, Chris was dead right there and Wayne was dead over there," explained Beatty's father. "The first bullet that was found hit Brandy, my daughter-in-law. When I went to help Wayne, I looked at his mouth and I couldn't handle that. He was just walking around, half of his face shot off."

Family members of all the victims said they want to know if deputies are looking for the woman they're accusing of starting the fight.

Harris County Sheriff's Office personnel are not commenting on the investigation right now.

"I was in the Vietnam War and I saw a lot of bad stuff, but with that right here, I ain't never saw that, you just don't shoot an unarmed man," said Beatty's father.

Beatty was also a vet and served in the Navy, his family said. He leaves behind three children.

Brandy Rusher, a former contestant on America's Next Top Model, is recovering at the hospital along with her brother Isaiah.

The sixth victim was a 16-year-old girl who was an innocent bystander.

Ty-Bra Baptiste was shot in the backside and the bullet went through her colon.

She's still recovering at LBJ Hospital.
