Man wants new trial in pregnant wife's murder

HOUSTON – A man convicted of killing his pregnant wife wants a new trial.

A jury found David Temple, a high school football coach, guilty of murder in the 1999 death of his wife, Belinda.

Belinda Temple, a teacher, was pregnant with the couple's second child when she died after suffering a shotgun blast to the head. Her body was found in a closet in their home.

David Temple's attorney has maintained that his client is innocent, and he is now pushing for a new trial. Dick Degeurin claims that Harris County prosecutors withheld evidence that points to other people being responsible for the slaying.

"This is about David Temple's innocence," Degeurin said. "We want this heard by a court as quickly as possible because we're concerned about the safety of the informant."

David Temple's parents were in the courtroom for a hearing that was held Wednesday morning. Victim's rights advocate Andy Kahan was in the courtroom to represent Belinda Temple's family.

"They were hoping this would be over," Kahan said. "They're going through such an emotional rollercoaster right now. It's hard for them to describe their feelings."

David Temple is serving a life sentence.

KPRC Local 2 legal analyst said the court does not have jurisdiction to grant a new trial because his conviction is being appealed.
