The 38-year-old driver in a BMW was heading southbound and didn't see the pedestrian until he walked out in front of him, police said. The pedestrian was struck by the middle of the car, investigators said.

The man was transported to Ben Taub, where he later died.

The driver was not hurt. He was taken into custody and charged with DWI.

Around 4 a.m., a separate car with two occupants driving south on Blalock slammed into the police car as it was investigating the fatal accident.

The HPD officer inside the car was transported to the hospital with minor bumps and bruises, authorities said.

The two people in the car that struck the officer's vehicle were not hurt. Police said they are testing both for the presence of alcohol.
