HOUSTON – There has been no finding of contempt on the part of Dick DeGuerin, who was accused by Harris County prosecutors of violating a gag order in the Lee Gilley murder case, according to DeGuerin’s attorney Brian Wice.
The issue came before Judge Peyton Peebles Monday, after Harris County District Attorney’s Office general counsel Joshua Reiss and Wice filed a motion and response, respectively, full of heated language over DeGuerin’s interviews with news stations last month.

The attorneys met with Judge Peebles behind-closed-doors Monday morning to discuss getting rid of certain language in the gag order about restricting all interviews with the media, Wice said.
Judge Peebles is expected to amend the gag order within the next 24 hours based on the parties’ proposed agreement, Wice said.
DeGuerin also announced after the court setting that Gilley will have a new hearing in Italy on Aug. 19 related to his request for asylum.
“My comments have always been guided by the rules,” DeGuerin said outside the courtroom Monday. “I will continue to speak out within the bounds of what the judge says he wants our comments limited to.”
DeGuerin made comments to the media earlier this month after an Italian court temporarily blocked Gilley’s extradition, citing concerns over possible death penalty punishment in Texas. The court has asked for clarification from the U.S. government, after Gilley cut off his ankle monitor and fled the country in May, weeks before trial was scheduled to begin in the capital murder case of his pregnant wife Christa Bauer.
