Houston attorney Tony Buzbee to speak Tuesday on case of Texas A&M student who fell to her death from Austin high-rise

Parents of Brianna Aguilera also scheduled to be in attendance

HOUSTON – Houston attorney Tony Buzbee has called a press conference to discuss the case of Brianna Aguilera, a Texas A&M student who fell to her death from an Austin high-rise apartment just hours after attending a tailgate for the A&M-Texas rivalry football game.

The press conference is scheduled to take place at 1 p.m. on Tuesday.

Aguilera was found dead on Nov. 29, 2025. Her death left her family seeking answers and questioning the account given to them of how she died.

Brianna’s mother, Stephanie Rodriguez, said her daughter was not suicidal and described her as a driven, happy student.

“She loved life, she was full of life, she loved school, she was very studious,” Rodriguez said.

Rodriguez said Brianna went to a tailgate and then a gathering at a high-rise apartment. At some point, she said, the communication she relied on to feel her daughter was safe suddenly stopped.

“Her phone was even placed on do not disturb, and she never does that,” Rodriguez said. “Our rule was okay, you go out, but you leave your location on, and if I call you, you answer.”

Hours later, she received the call she had feared.

“I get a call an hour later, about 4 p.m., and they told me that my daughter was deceased in a morgue,” Rodriguez said.

Since then, she said, what she has heard about what happened that night “doesn’t make sense.”

“There’s a lot of inconsistencies with the story,” Rodriguez said. “He told me that they said she jumped, and then he told me that the friends said that they didn’t know her whereabouts, that they didn’t see her, they saw the balcony door open, so they just closed it.”

Tony Buzbee is representing the family and called for a new investigator to be assigned to the case in a December 2025 press conference.

“None of the things that we’ve been told by the Austin Police Department are consistent with the actual facts that we’ve learned,” Buzbee said during the press conference.

The Austin Police Department responded to the press conference, saying it stands by the information provided in a press conference the day before Buzbee’s, adding that APD has never made a cause or manner of death determination in the case and the investigation remains open.

“We understand emotions are extremely high and that Brianna’s passing has brought immense pain to her loved ones. We share in that sorrow. This is still an active and ongoing investigation. The misinformation that has been shared harms innocent people and jeopardizes the integrity of the investigative process. From the beginning, our priority has been and continues to be, to conduct a thorough, complete, and respectful investigation,” an APD spokesperson told KPRC 2 News.
