Garcia is now charged with aggravated assault against a public servant and burglary of a habitation.

According to HPD, Garcia knocked on the back door but the family did not answer. Investigators said Garcia then fired the gun through the back door and forced his way into the home. The family escaped through the front of the house and ran across the street for help.

Neighbors called 911 and saw the suspect exit the back of the home. Neighbors then yelled for the suspect to stop and followed him a short distance until he pulled a gun and fired in their direction.

When an officer arrived on scene, he said he saw Garcia holding a pistol. HPD said the officer gave Garcia verbal commands to drop the gun and get on the ground, which Garcia ignored and continued to walk away. HPD said the officer pursued Garcia and gave him verbal commands, at which point Garcia pointed his gun at the officer. That's when the officer fired his weapon and shot Garcia.

Garcia suffered non life-threatening gunshot wounds and was transported to Memorial Hermann Hospital.
