Man loses lawsuit against officer who shot him during traffic stop

BELLAIRE, Texas – A judge made his ruling Monday in a wrongful shooting lawsuit.

Robbie Tolan was shot by a Bellaire police officer during a traffic stop in 2008.

Bellaire police said Officer Jeff Cotton suspected Tolan was driving a stolen SUV. Tolan was shot after being ordered to get down on the ground in his front yard.

The SUV Tolan was driving was not stolen.

The shooting led to claims of racism, and Cotton was charged with aggravated assault. In 2010, Cotton was found not guilty.

Tolan, the son of former pro baseball player Bobby Tolan, filed a civil lawsuit was filed against Cotton and his partner, John Edwards. He claimed the shooting fits a pattern of racial profiling and discrimination on the part of the Bellaire Police Department.

On Monday, a judge decided that the officers did not have to pay Tolan anything.

KPRC Local 2 has reached out to Tolan family and Cotton for comment, but has not yet received a response.
