HOUSTON – The heated battle over the Ashby high rise proposed to be built near Rice University may soon come to an end.

Mayor Annise Parker sent out a letter to South Hampton residents saying the city has no legal basis to stop developers, Maryland Manor Associates, from building the tower. She said that the city's lack of zoning laws limited its options.

Under the settlement's terms, the city will approve the 21-story, 228 unit and more than 10,000-square-foot building.

There are several measures in the settlement that were aimed to ease some of the residents' concerns. There are some rules for the building's driveways, weekday shuttle service to the Texas Medical Center for the building's residents will be required and there are aesthetic regulations.

Parker said she believes the wrong project is being constructed in the wrong place.
