CVS employee accused of assaulting man at store

HOUSTON – A CVS employee is facing charges after an altercation with a customer.

Simon Rutherford, 50, is charged with assault.

Police said a woman was trying to return batteries at about 3:30 p.m. Wednesday at a CVS in the 7500 block of Westheimer Road. Investigators said a store clerk told the woman she couldn't return the batteries without a receipt.

Authorities said the woman tried to leave the store, but was approached by Rutherford, a loss prevention employee at CVS. Officials said Rutherford demanded the woman go back into the store.

Houston police said the woman's boyfriend went inside the store to see what was happening and got into a scuffle with Rutherford. Rutherford is accused of assaulting the man.
