HOUSTON - A 7-year-old boy died Saturday night after a car, driven by a man suspected of driving drunk, slammed into the porch he was standing on.

Police said the car was driven by Luis Hector Lopez, who has been charged with intoxicated manslaughter and is being held without bond.

Police said Lopez was going west on Harwin Street, when he lost control of his Ford Crown Victoria, hopped the median and slammed into the downstairs corner apartment in a complex at 10200 Harwin just before 11 p.m. Saturday.

A 4-year-old boy was also standing on the porch and was hurt in the accident. He remained in the hospital with burns over 40 percent of his body.

Neighbors said the boys were standing on the porch because the family was having a barbecue.

"It's just horrific," said neighbor Octavio Gomez. "I got here before the police actually arrived. I looked inside and there was a lot of blood and I seen the boy on the ground, not moving."

A man at the scene who identified himself as a cousin said the boys lived in the apartment with their mother, her boyfriend and two other small children. He said when the accident happened the boys were outside with the mother's boyfriend, who wasn't hurt in the accident.

It's unclear if they'll continue to live in the apartment.

Houston police are investigating.
