Man accused of attempting to kidnap same girl twice

BAYTOWN, Texas - A 39-year-old Houston man with a history of sexual assault against a child is back behind bars, accused of trying to kidnap an 8-year-old Baytown girl.

Baytown police arrested Cleofas Garcia at the Tanglewild apartments in the 3200 block of Garth Road. The child told police Garcia was watching her as she played with friends just outside his apartment door Saturday.

"She said the dude had dragged her by the arm to put her in the house," the girl's mother Jennifer Williams said.

The girl said when she screamed Garcia let her go. She didn't tell her mother until she said Garcia tried to snatch her again on Sunday. That's when her family called police.

"I don't know what would have happened, I don't know what would have happened to me if he would have done anything to my child," Williams said.

Records show Garcia served five years behind bars for sexual assault of a child in 2002. When he got out in 2007 he was forced to sign up on the state's sex offender list.

"He's apparently registered in Houston. He since moved to Baytown in early July. State law requires registering within seven days of moving and he has yet to do so," Baytown police detective Brian Parker said.

The state registry ranks each sex offender's possible threat to the community as either level 1, 2 or 3. Garcia was listed at level 2, meaning the state felt he was at moderate risk for re-offending.

Garcia is being held at the Baytown Jail on $10,000 bond. He faces felony charges of attempted kidnapping and failure to register as a sex offender.
