FORT BEND COUNTY – One of Rosenberg's most popular restaurants has been served with a lawsuit for allegedly contaminating a Fort Bend County couple with cyclospora.
Kennon and Lyndsay Smith said they were infected with the parasite shortly after eating at Bob's Taco Station on Avenue H. The lawsuit also names two of Bob's produce suppliers: Taylor Farms and Max Luna Produce.
Cyclospora is a parasite typically spread through feces-tainted produce.
"They had all of the cyclospora symptoms such as vomiting, nausea, diarrhea, abdomen pain," said Ron Simon, one of the attorneys representing the Smiths. "They initially sought the doctors treatment, got treated, and hoped it would go away. the problem was, it didn't."
A cyclospora outbreak has sickened hundreds of people across the country, including more than 250 in Texas. That includes 36 confirmed cases in Fort Bend County. Four of those people had to be hospitalized.
The Smith's are seeking monetary compensation, but said they also want restaurants held to a higher standard.
"We're going to be able to find out just how feces got into the food," said Simon. "We're going to be able to make changes within these companies to make sure it doesn't happen again and to make sure no on else gets sick."
Simon is representing dozens of people across the country who were contaminated with cyclospora. He said his firm plans to file more lawsuits related to the outbreak, including in Texas.
