Hearing about future of David Temple case rescheduled

HOUSTON – A hearing that was set for this week for a man released from jail after he was convicted of killing his pregnant wife 17 years ago was rescheduled Wednesday.

David Temple spent nine years in jail after a jury convicted him in the 1999 shooting death of his wife, Belinda. After a lengthy appeals process, he was released from jail on bond in December, while he awaits a new trial.

Temple was scheduled to return to court Friday for a hearing, where the future of his case was expected to be discussed. However, court records showed that the hearing was rescheduled for May 5.

Newly-elected Harris County District Attorney Kim Ogg said she needs another 60 days to review the case, according to the court records.

Prosecutors argued during the 2007 trial that Temple killed his wife so that he could be with his mistress. The defense argued that a teenage neighbor, who admitted to burglarizing the couple’s home, was the real killer.

Ultimately, Temple was convicted of murder and sentenced to life in prison.

Temple has maintained his innocence.

The victim’s family has said they hope Ogg will opt to retry the case.
