HOUSTON – A Harris County grand jury has declined Friday to indict Chad Holley in the 2016 shooting death of a man in north Houston.
Holley was at the center of one of Houston’s biggest police brutality cases, when surveillance video showed officers beating Holley during a burglary arrest in 2010.
Holley was charged with capital murder in December in connection with the Sept. 21, 2016, killing of David Trejo-Gonzalez, 42.
Investigators said Trejo-Gonzalez was walking from his car to his apartment when he was confronted someone who demanded his money and then shot him. The shooter then jumped into a truck and fled with an accomplice.
It was alleged that Holley told a friend that he had shot someone over a drug dept and told police he saw Holley throw a gun into a dumpster, officials said.
Prosecutors said Friday that although the grand jury declined to indict Holley in the case, the law allows for the group to consider the matter again if new evidence emerges.

Seven police officers were fired after Holley was beaten. Three were convicted of official suppression.
Since that time, Holley has had several brushes with the law. He was found guilty of the original burglary case and then convicted for a second burglary in 2012, for which he received a deferred adjudication.
Holley was already in custody on an unrelated theft charge when he was charged in the Trejo-Gonzalez case.
He was being held in jail Friday.
