Twin 4-year-olds hurt

HOUSTON - Houston police are investigating a single car crash that killed a 9-year-old boy and injured his twin sisters Friday morning.

Just before noon, investigators said a black Toyota SUV was traveling east on Edgebrook Drive in southeast Houston, when the driver lost control, hopped a curb, flipped and slammed into a tree. 

The driver and all three kids inside were ejected. Police said they were not wearing seatbelts.

James Phillips, 9, died at the scene. His 4-year-old twin sisters, Joylyn and Loveressa Phillips were taken to the hospital. One suffered a broken leg, the other a broken arm.

"It's still unbearable to even explain it, " said Rose Terry, the children's grandmother. "It's just like your whole heart just falls out of your chest."

Terry and her husband, Joe, arrived at the scene moments after the crash. They told KPRC Local 2 they saw their grandson lying on the ground.

"I checked him and he was already gone, " said Joe Terry. "They were doing CPR, his chest was crushed and he had injuries to the left side of his head."

The Terry's believe their grandchildren were buckled in, but that seatbelts weren't enough. They said because of their size and age the children should have been restrained in booster seats. 

HPD investigators said the driver, who was also injured in the crash and taken to the hospital, was driving fast when he lost control. Officers on the scene said they won't know if he faces charges until the investigation is complete. 

Family members said the driver of the SUV is engaged to the children's mother. She was following behind the SUV in a separate vehicle and saw the crash happen.

"When you're dealing children, I don't care who it is, you have to make sure those children are protected," said Joe Terry. "When they're in your vehicle you have to make sure they're in the seat and if something happens you got to pay the price. He took a life. Whatever they do to him it won't bring James back."
