The off-duty officer said he approached two men after they were seen leaving the restaurant with an open container of alcohol.

When the officer told the men they couldn't leave with the open container, the men got upset, according to police.

The two men, who were described by police as Hispanic, got inside a black, four-door BMW SUV and fired shots into the air and in the direction of the officer, police said. The officer was not hit.

Zacarias is charged with aggravated assault of a public servant and forgery of a government financial document in the 262nd State District Court and unlawful carrying of a weapon in Harris County Criminal Court.
