$1,000 Gas Card Giveaway Official Contest Rules
- HOW TO ENTER THE SWEEPSTAKES: a. The "$1,000 Gas Card Giveaway" (the "Sweepstakes") will begin Friday, Nov. 4, 2005, and will run until and including Friday, Nov. 18, 2005, between the hours of 6 a.m. and 7 a.m. central time (the "Sweepstakes Dates"). b. To participate in the Sweepstakes, KPRC-TV Local 2 (the "Station") viewers will need to watch during the Sweepstakes Dates for the "cue to call" (there will be one (1) "cue to call" during the Sweepstakes Dates) and then call 1-713-390-KPRC (713-390-5772). Pending verification of eligibility, the 10th caller after the "cue to call" is given will be a winner. In case of a disconnect of the 10th caller, the next caller to make it through will be the winner. At the time of their call, each designated caller will be required to provide all information requested, including their full name, complete address, including ZIP Code, daytime and/or evening phone numbers, their date of birth and Social Security Number to be eligible to win. c. There is no limit to the number of times a viewer can try to call in and win. A viewer may only win once during the promotion, and only one winner per household can win during the run of the promotion. For this Sweepstakes only, restrictions that would prevent a viewer from winning if he/she had won another recent Station contest or sweepstakes will not apply. d. Neither the participating station nor their licensees, corporate parents, will be responsible for telephone service outages, delays, interruptions, busy signals, equipment malfunctions and any other technical difficulties or for any medical emergencies which may interrupt or prevent completion of a telephone call. ELIGIBILITY RESTRICTIONS: a. The Sweepstakes is open to legal residents of the 50 United States or the District of Columbia who are 18 years of age or older. Employees of KPRC-TV, Post-Newsweek Stations, their affiliates, distributors, dealers, subsidiaries, parent corporations (collectively "Sweepstakes Entities"), their affiliated advertising agencies, participating sponsors/promotional partners, other television stations in the metropolitan areas of the participating stations and members of their immediate families (parents, children, siblings, spouses) or persons living in the same households as such persons, whether related or not, are ineligible to participate or win. Void where prohibited. PRIZES: a. Each Prize is one thousand dollars ($1,000) worth of Shell Gas to be allotted in individual $100 denomination and/or $25 denomination cards. Shell Group or any of its fuel stations or subsidiaries are not affiliated in any way with this sweepstakes. Only one (1) Prize will be awarded per winner. All taxes, including but not limited to, federal, state, and local taxes, and any other costs and expenses associated with the acceptance and use of a prize are solely the responsibility of the winner. The Prizewinners will each be issued an IRS Form 1099 for the ARV of the Prize. Some restrictions may apply. Prize cannot be transferred, substituted or redeemed for cash except at Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize, or portions thereof, with a prize of equal or greater value, at its sole discretion. All prizes are awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied, (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose) by Sponsor. Four (4) Prizes will be awarded throughout the entirety of Sweepstakes. b. Pending verification of each winner’s eligibility, winner must pick up the prize at the KPRC-TV studios unless other arrangements have been made between Winner and Station. Any prize not claimed within forty-five (45) days of winning will be forfeited by the winner. WINNER SELECTION AND NOTIFICATION: a. Decisions of KPRC-TV with respect to the Sweepstakes are final. b. Potential winners will be determined as described in Section 1(b) above. c. In the event of a tie, duplicate claims, or multiple persons claiming to be the correct caller, a final and binding decision will be made by KPRC-TV, which reserves the right to hold a random drawing in such event to determine the winner. d. In the event of an equipment malfunction, KPRC-TV reserves the right to award a random caller within 24 hours with the prize. e. Odds of winning depend upon the number of calls received. f. Winners must execute and return any required Affidavit of Eligibility and/or Release of Liability Prize Acceptance Form within fourteen (14) days of winning. If winner is under the age of majority in his/her state of residence (a "minor"), prize may be awarded in the name of his/her parent or legal guardian who will be required to complete and sign any required documents. Failure to timely return any required executed documents may cause prize to be forfeited as solely determined by KPRC-TV. Prizewinner must claim or take delivery of the Prize within forty-five (45) days of winning or the prize may be forfeited. CONDITIONS: a. Payments of all federal, state, and local taxes are solely the responsibility of the winner. Winners will be required to sign an IRS Form W-9 or the equivalent. b. By participating in the Sweepstakes, winners agree to have their name, voice, and likeness used in any advertising or broadcasting material relating to this Sweepstakes (for the Station or any other participating station) without additional financial or other compensation, and, where legal, to sign a publicity release confirming such consent before delivery of the prize. Where legal, winners also agree to provide KPRC-TV with an interview, which may be used in connection with the Sweepstakes. c. Sweepstakes winners and/or legal guardians will be required to sign a liability release prior to delivery of the prize. Pursuant to the liability release, winners will agree to hold Sweepstakes Entities and their officers, shareholders, directors, employees, agents and representatives harmless against any and all claims or liability arising directly or indirectly from the prize or Sweepstakes. By participating, Sweepstakes winners release the Sweepstakes Entities, and their agents, advertising and promotion agencies, affiliated companies, Sweepstakes partners and prize suppliers, and all of their respective affiliated companies, employees, officers, directors and shareholders, from and against all claims and damages arising in connection with each entrant’s participation and/or entry in the Sweepstakes and/or their receipt or use of any prize awarded in this Sweepstakes. Prizes will be awarded "as is" and any and all warranties and/or guarantees are subject to the terms and conditions of the manufacturer and/or dealership thereof, and winner agrees to look solely to such manufacturer and/or dealership for any such warranty and/or guarantee. This Sweepstakes is governed by U.S. law and is subject to all federal, state and local laws. Void where prohibited by law. d. KPRC-TV reserves the right to make changes in the rules of the Sweepstakes, including the substitution of a prize of equivalent value, which will become effective upon announcement. e. KPRC-TV, in its sole discretion, reserves the right to reject calls from any phone number or phone numbers and to disqualify any person or person who KPRC-TV believes is tampering with the entry process in any way, including but not limited to attempts to manipulate the phone system or entry process in order to increase the odds of winning, any other fraudulent activity designed to affect the entry process or who is otherwise in violation of the rules or of any applicable law or regulation. KPRC-TV further reserves the right to cancel, terminate or modify the Sweepstakes if it is not capable of completion as planned. f. Contestants understand, acknowledge and agree that KPRC-TV shall not be liable for losses or injuries of any kind resulting from the rejection of an entry given KPRC-TV's belief that the contestant was abusing or tampering with the Sweepstakes entry process in any manner or due to any technical malfunction of the telephone network/transmission line or any entries that are late, delayed, garbled, incomplete, misdirected, lost, corrupted or otherwise not in compliance with the rules or applicable law. g. The Station and KPRC-TV are not responsible for typographical or other errors in the printing, the offering or the administration of the Sweepstakes, or in the announcement of a prize. h. Failure to comply with the Sweepstakes rules may result in a contestant’s disqualification solely at the discretion of the Station or KPRC-TV. i. Copies of the written Sweepstakes rules are available during regular business hours at the main studio of KPRC-TV, 8181 Southwest Freeway, Houston, TX, 77074.
