  1. How to Enter: The WNBC / KNBC / WMAQ / WRC /WCAU/KXAS/WTVJ/KPRC/WDIV Bally Total Fitness "Meet Your Potentialsm" Sweepstakes ("Sweepstakes") begins on January 2, 2006 at 12:01 a.m. ET and ends on February 5, 2006 at 11:59 p.m. ET ("Sweepstakes Period"). For purposes of this Sweepstakes, all times refer to Eastern Time ("ET"). To enter, access one of the following Sweepstakes Web sites: http://www.wnbc.com; http://www.nbc4.tv; http://www.nbc5.com; http://www.nbc4.com http://www.nbc10.com http://www.nbc5i.com http://www.nbc6.net; http://www.click2houston.com; or http://www.clickondetroit.com (each a Web Site, collectively "Web Sites"). Once there, click on the Sweepstakes icon or text link, either of which will take you to the Sweepstakes home page and entry form. Then, complete and thereafter transmit the entry form ("Entry"). Information required on the entry form (collectively "Entry Information") consists of your first and last name, complete address (including zip code), telephone number (including area code), date of birth, and e-mail address. Participants may only in the Geographic Area (defined below) in which they reside, and they may only enter at one Web Site. Limit one (1) Entry per person/per email address/per day. Entries in excess of the stated limit will be disqualified. Entries must be received by 11:59 p.m. ET on February 5, 2006. All required Entry Information must be completed in full. Any attempted form of entry other than as described herein is void.


  2. Eligibility: This Sweepstakes is only open to legal U.S. residents who are physically located and residing within the terrestrial broadcast signal geographic areas of one of the following NBC stations (each a "Geographic Area;" collectively, "Geographic Areas"): WNBC New York, NY in the states of New York, New Jersey, Connecticut and Pennsylvania; KNBC Los Angeles, CA - Los Angeles, Orange, Riverside, San Bernardino or Ventura counties in California; WMAQ Chicago, IL - Cook, De Kalb, Du Page, Grundy, Kane, Kankakee, Kendall, Lake, La Salle, McHenry, Will, Jasper, Lake, La Porte, Newton, and Porter counties in Illinois; WRC Washington D.C - the District of Columbia; Arlington, Fairfax, Prince William, Spotsylvania, Stafford, Frederick, Clarke, Fauquier, Loudoun, Warren, Jefferson, Culpeper, King George, Orange, Page, Rappahannock, Shenandoah, Westmoreland, Berkeley, Grant, Hampshire, Hardy, Mineral, and Morgan Counties in Virginia; Montgomery, Prince George's, Calvert, Charles, Frederick, Allegany, St. Mary's, Washington Counties in Maryland; and Fulton County in Pennsylvania; WCAU Philadelphia, PA - Berks, Lehigh, North Hampton, Bucks, Montgomery, Chester, Delaware, and Philadelphia counties in the state of Pennsylvania; Burlington, Camden, Gloucester, Cape May, Atlantic, Salem, and Cumberland counties in the state of New Jersey; and New Castle and Kent Counties in the state of Delaware; KXAS Dallas, TX - Dallas - Denton, Tarrant, Collin, Ellis, Hood, Johnson, Parker, Rockwall, Kaufman, Hunt, and Wise in Texas; WTVJ Miami, FL - Dade, Broward and Monroe County in Florida; KPRC Houston, TX; or WDIV Detroit, MI (collectively, "Sponsors"), and who are 18 years of age or older as of January 2, 2006. Employees of NBC Universal, Inc., Sponsors, Bally Total Fitness® Corporation, Skycastle Entertainment, Inc., Sullivan Compliance Company, those involved in the development, production (including prize suppliers), implementation and distribution of this Sweepstakes, their advertising or promotion agencies, parent companies, agents, officers, directors, subsidiaries or affiliates, participating stations, service providers, any other persons or entities directly associated with this Sweepstakes (collectively "Sweepstakes Entities"), members of their immediate families (parents, children, siblings, spouses), and/or persons living in the same households as such persons (whether related or not) are ineligible to enter the Sweepstakes.
  3. PRIZE/ODDS OF WINNING: One (1) Prize): Winner will receive a one (1) year non-renewable Bally Total Fitness® nationwide access membership ("Membership"),one (1) year of Personal Training sessions ("PT") at a Bally Total Fitness® (exact Bally's location to be selected by Sponsors in their sole discretion) in or near winner's hometown, and $2,500 cash. Approximate Retail Value: $4,800. Odds of winning the prize depends on the number of eligible Entries received. If Membership and/or PT by winner is not started within one (1) year of notification of winning, they will be forfeited. Membership/PT are non-transferable. PT to be awarded as one (1) sixty-minute session per two weeks for fifty-two (52) consecutive weeks for a total of twenty-six (26) sessions Winner must sign and return to Bally Total Fitness® a Complimentary Membership Agreement in order to activate the membership and PT sessions. Winner solely responsible for all costs, incidentals, and expenses not specifically mentioned as being included, including but not limited to any requested Membership upgrades. No substitution, transfer, or cash equivalent for prize (or prize components), except that Sponsors may substitute a prize (or prize component) of equal value for any reason. In the event that a prize component is not available for any reason, then the remaining elements of prize shall constitute full satisfaction of Sponsors' prize obligation to winner and no additional compensation will be awarded. Prize notification will be shipped to a street address in Geographic Areas only. Any depiction of prize is for illustrative purposes only. All federal, State, or other taxes are the sole responsibility of winner. Winner will receive an IRS Tax Form 1099 from the Sponsors for the total ARV of the prize (stated herein) that he/she has won in t he calendar year he/she won.
  4. Drawing and Notification: Potential winner will be randomly selected in a drawing held on or about February 13, 2006 from among all eligible Entries received by Sweepstakes Administrator ("Drawing Date"). Potential winner (or if a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal/guardian) will be notified by phone, mail and/or email within approximately two (2) weeks of Drawing Date. If potential winner (or if a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal/guardian) cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, and/or if his/her prize or prize notification is returned as undeliverable, potential winner will be disqualified and an alternate potential winner may be selected from the remaining eligible Entries, at Sponsors' sole discretion. In such case, prize may be substituted with a prize of equal or greater value.


  5. General Conditions: Sweepstakes is subject to these Official Rules and all federal, state, and local laws (collectively "Rules and Laws"). Potential winner (or if a resident of a jurisdiction that deems him/her to be a minor, his/her parent or legal/guardian), at Sponsors' sole discretion, may be required to execute, sign, have notarized and return an Affidavit of Eligibility, a Liability Release, a Publicity Release and any other documentation that Sponsors require (collectively "Affidavit/Release"), within five (5) days after receipt by potential winner or potential winner may be disqualified and an alternate potential winner may be selected at Sponsors' sole discretion. By returning the completed Affidavit/Release, winner attests to the authenticity of his/her winning Entry. If winner is a resident of a jurisdiction that deems him/her to be a minor prize will be awarded in the name of his/her parent or legal/guardian. Once submitted, Entries become the sole property of the Sponsors and will not be acknowledged or returned. Any personal information supplied by entrants to Sponsors or their affiliates will be subject to Sponsors' Privacy Policy. Thus, except where prohibited by law and Sponsors' Privacy Policy: (1) entry and/or winners' acceptance of prize constitutes permission for the Sweepstakes Entities to use winners' name, address (city and state), photo, likeness, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media, in perpetuity, without further notice to or compensation in connection with said Sweepstakes or the prizes awarded and (2) Sponsors have the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such Entries however they see fit and for any purpose without any notice or compensation to entrant or any third parties. Any person attempting to defraud or tamper with this Sweepstakes will be prosecuted and is not eligible for the prizes. If, for any reason, the Sweepstakes is not capable of running as originally planned, Sponsors at their sole discretion, reserve the right to cancel, suspend or modify Sweepstakes or any portion(s) thereof and conduct the drawing from among all salvageable eligible Entries received, if any. In case of a dispute over the identity of the entrant who submitted a winning Entry, Sponsors reserve the right to deem the registered subscriber of the email account to be the entrant.
  6. Disclaimers: Sweepstakes Entities are not responsible or liable for multiple Entries beyond those authorized by these Official Rules. Entries that are entered by other than human means (such as by an automated computer program or any non-human mechanism, entity, or device), or Entries that are illegible, late, tampered with, forged, incomplete, misdirected, lost, misplaced, stolen, destroyed, or otherwise not in compliance with these Official Rules will be disqualified. By entering Sweepstakes, entrants agree and acknowledge to be bound by the Rules and Laws, as well as the decisions of Sweepstakes Administrator, which are final and binding in all respects; and to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Entry Information; acceptance/possession and/or use/misuse of the prize awarded herein; any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; interruption or inability to access Sweepstakes, Web Sites or online service via the internet due to hardware or software compatibility problems; any damage to any entrant's (or any third person's) computer and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions, even if caused by the negligence of one of the Sweepstakes Entities. Entrants further agree to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from their participation in the Sweepstakes and/or the acceptance and/or use of the prize, and to release all rights to bring any claim, action or proceeding against the Sweepstakes E ntities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prizes. The failure of Sponsors to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of Sponsors (excepting compliance with applicable codes and regulations) or other force majeure event will not be considered a breach of these Official Rules.
  7. Winner's Name/Rules: For the name of the winner or for an additional copy of these Official Rules, send a self-addressed, stamped envelope to: WNBC / KNBC / WMAQ / WRC/WCAU/KXAS/WTVJ/KPRC/WDIV Bally Total Fitness "Meet Your Potentialsm" Sweepstakes "RULES"/"WINNER'S NAME" (specify which), P.O. Box 6493, Burbank, CA 91510. All requests must be received by April 5, 2006. Name of winner may also be posted on Web Sites.
