Wrongful death lawsuit filed against former Rockets player Marcus Camby

PEARLAND, Texas – A wrongful death suit has been filed against former Rockets player Marcus Camby, according to court documents.

Marcus McGhee, a 9-year-old boy with autism, disappeared from the 6700 block of Fite Road on Nov. 24, 2016.

Pearland police said the boy's body was found around 7 a.m. in a pond near McGhee's family's home a day later.

McGhee is related to Camby, police said. McGhee and his family were at Camby's home when he disappeared.

The lawsuit blames Camby for his nephew's death.

The lawsuit states Camby knew his nephew needed around-the-clock supervision, which he didn't provide.

The plaintiff in the lawsuit is McGhee's father, who is not related to Camby.

McGhee came to Pearland with his mother to spend Thanksgiving with his uncle (Camby) and other relatives.

McGhee wandered away from family. He was found in a pond on the property.

"Camby failed to supervise Marcus while he was at his house. Camby also put no protective measures in place to keep Marcus from the pond," the lawsuit states.

The lawsuit requests a trial by jury and an unspecified amount for losses ranging from pain and suffering to alleged irresponsibility.

The plaintiff's lawyer released the following statement:

"The preventable death of nine-year-old Marcus McGhee prompted this legal action. This wrongful death lawsuit is intended to help Marcus’ father find answers to troubling questions about what truly happened at the home of his son’s uncle, Mr. Camby. Marcus’ father was not at Mr. Camby's estate at the time his son went missing. Had Mr. Camby exercised the most basic of precautions to protect Marcus while he was at his property, he would still be here today."
