Stewart, 18, has been in the Harris County Jail since his November arrest and charged with aggravated assault with a deadly weapon in connection with the shooting.

In February of this year, Stewart and his brother, Marvin, were also charged with tampering with evidence. Marvin Stewart is not in custody.

Richardson, 17, and Arielle Olivia Shepherd, also 17, were killed, and about 20 others injured, when suspects started firing guns during a house party that had been advertised as a birthday celebration on Twitter and other social media networks.

Investigators are still actively looking into the death of Shepherd.

According to the Harris County Sheriff's Office, the gun in the tampering case has not been found despite an extensive search.
