Some Houstonians may not be allowed to rent out homes for Super Bowl

HOUSTON – Some Houstonians may not be allowed to rent out their homes for Super Bowl 51 because of a recent lawsuit.

This week a San Antonio court of appeals ruled in favor of a homeowner's association that sued a homeowner who rented out his home on several short-term leases.

According to the lawsuit, the homeowner, Kenneth Tarr, also advertised online, even though his deed prohibited anything but residential use of the home.

Attorneys said the ruling calls into question the legality of all Texas short-term rentals when the leasing takes place in a deed-restricted residential community, meaning Houston residents hoping to rent out their homes for the Super Bowl could get into legal trouble if their homeowner's association, condo association, or even neighbors take them to court.
