A former Brazoria County assistant district attorney was arrested and charged with driving while intoxicated, according to court document and Houston police.
Michael Anthony Abner, Jr. was arrested on October 19 after police said they received calls from drivers reporting a vehicle swerving and nearly hitting other cars on the Gulf Freeway near Almeda-Genoa.
Police said they caught up with Abner's car as it was driving "at a slow rate of speed" along Clear Lake City Boulevard. Police said Abner's car eventually came to a complete stop in a moving lane of traffic. Police said Abner refused a field sobriety test and initially told officers he was a "law student coming home from a bar." Police said Abner then fell asleep in the back of a patrol car while being taken to jail.
Brazoria County District Attorney Jeri Yenne told Local 2 she was "deeply disappointed" by Abner's arrest, adding she has an office policy prohibiting employees from drinking any amount of alcohol and driving.
Yenne said she was also disappointed that Abner did not report his arrest to his supervisors in the DA's office. Yenne said her office found out about the arrest from "outside sources."
Yenne said Abner has since "resigned in lieu of termination."
According to the State Bar of Texas, Abner received his law license in 2008.
