BAYTOWN – A Baytown man has been arrested and accused of pointing a BB gun at a police officer.

Franklin Hernandez Buruca was charged with aggravated assault on a public servant.

Baytown police said on Jan. 11, a neighbor told officers that Buruca was trying to break into his house in the 3400 block of Red Cedar Road.

When an officer arrived at the scene , he saw Buruca coming from his neighbor's house and approaching his residence while on his wheelchair, police said.

Buruca's mother said her son was suffers from a mental disorder and he went to his neighbors house to start a fight, police said.

After Buruca was taken back to his home and the officer began to leave, police said Buruca came out of his house and charged at the officer on his wheelchair. According to police, Buruca also had a BB gun in his hand and pointed it toward the officer.

The officer, fearing for his life, then pulled out his handgun and pointed it at Buruca, police said. The officer was able to disarm Buruca and take him down to the ground, police said.

Investigators said Buruca resisted arrest and tried to bite the officer before the officer was finally able to get control of Buruca and place him in custody.

Buruca was booked into the Baytown City Jail.
