Man involved in struggle over gun with deputy constable

SPRING, Texas – A man is in custody after physically attacking several deputies and grabbing one of their guns. The incident happened Friday evening in the 13000 block of Stonefield Drive. Deputies with the Precinct 4 Constable’s Office were responding to a family disturbance call.  

“At some point our deputies engage this individual,” said Constable Mark Herman. “He began to physically attack the officers. It came down to a basic hand to hand combat with this individual and three of our deputies.”

Officers deployed their Taser guns but Herman said it had no effect on the suspect who has been identified as Cardero Mitchell, 28.  They did manage to get the gun away from Mitchell but not before one shot was fired.

Mitchell has two warrants out for his arrest for aggravated assault of a family member. He has also been convicted of evading arrest in 2006, assault of a family member in 2006, possession of a controlled substance in 2008 and disarming a police officer in 2008.

“There was a shot discharged from that weapon,” he told KPRC. “Luckily it didn’t hit anyone.  They were eventually able to take this guy into custody.”

Herman said his deputies were banged up and bruised up in the attack but will be OK. Mitchell faces charges of aggravated assault on a police officer and disarming a police officer. Herman plans to ask the District Attorney’s Office to upgrade those charges to attempted murder on a police officer.  

“Here were are on the first day of the new year and this is not what we expect,” Herman said.  “To have an individual physically attack police officers and in this case try to kill our officers.”
