Tomball police said Diaz and the girl were both attending a birthday party for a church pastor's wife at Igelsia Taller Del Altarero in the 200 block of West Main on March 10, 2012.

The girl went to the restroom at the church and when she came out, Diaz was waiting in the lobby.

Detectives said Diaz asked the girl if she wanted to see a surprise in his truck, and she said yes.

Diaz took the girl to his truck and put her in the front seat, officials said. He lifted her shirt up and kissed and tickled her stomach, police said.

Investigators said Diaz made an inappropriate comment and the girl began to feel uncomfortable. She told him that they were going to get in trouble.

Diaz then yelled at the girl and told her to get out of his truck and go back in the church, officials said.
