A local homeowners association is suing nearly 120 of its residents.
Copies of the lawsuit were sent to dozens of families in this northwest Houston neighborhood. Many of them had signed a petition to allow taller fences along what was a golf course. But the deed restrictions regulate the fence height.
People here felt they were named in the lawsuit because they signed the petition aimed at making homes along the green space safer.
"I'm certainly not going to spend any money on this or hire an attorney. I think this is a colossal waste of our HOA dues, our time as citizens and I don't think we should be sued for simply signing a petition," said Erik Hendrickson.
An attorney for the homeowners association tells Local 2 the petition did not have enough valid signatures and the fence height will stay as it is.
The attorney says all of the homeowners are named in the lawsuit because the deed restriction applies to all of their homes. The attorney called it a legal formality.
