TOMBALL, Texas -

The case of a deadly auto-pedestrian accident that happened outside of a busy movie theater in Tomball earlier this week will go to a grand jury.

The incident happened on March 17 at the Silverado Movie Theater located in the 24700 block of Tomball Parkway.  When deputies arrived on the scene, they say they found a man in the parking lot who had been run over by a vehicle.

The victim had gone to the movies with a couple of friends. According the the Harris County Sheriff's Office, the victim and his friends got into a a verbal confrontation with two other men regarding the end of the movie they had just seen. 

The two men got into their white Ford F150 Crew Cab Truck when the victim approached them outside from the passenger side door. The driver put the truck in reverse, hitting the victim and knocking him to the ground. The victim later died at the hospital.

The truck fled the scene, but since the incident investigators have spoken to both the driver and passenger.

A grand jury will consider whether criminal charges should be filed in the case
