Deputies: Man killed neighbor over motorcycle noise

CONROE, Texas – A father who ran an indoor marijuana operation is in jail, accused of killing his neighbor over the noise from his motorcycle, authorities said.

Montgomery County sheriff's deputies said Jamie Ryan Devita, 33, confronted Marcus Fisher around 5 p.m. on Dec. 6 in in the 16900 block of West Hammon. Investigators said that's when Devita shot him during a resulting argument.

Fisher died of a shotgun wound to the chest.

Authorities said Devita had been upset with the noise from Fisher's motorcycle on more than one occasion and complained to neighbors, but didn't confront him about it until that night.

Devita was indicted last week by a Montgomery County grand jury. He is in the Montgomery County Jail on $200,000 bond. He faces five to 99 years or up to life for first-degree felony murder.

Meanwhile, Devita's wife, April Nicole Devita, 30, was indicted on two counts of endangering a child.

Sheriff's deputies said they entered the Devita home after the shooting began, and found April Devita and 2-year-old and 4-year-old children hiding.

Deputies said they discovered an indoor marijuana plant grow operation and guns reported to be within reach of the children.
