BAYTOWN, Texas -

Baytown police shot a man after they said he threw pieces of concrete at them Tuesday.

Emergency medical workers said they were called to 1700 Bob Smith Road after they received reports that a man was beating his girlfriend and that she had broken bones in her face. Paramedics saw the man walking up the street and called police.

An officer confronted Shane Phillips, 35, who they said threw a jagged piece of concrete at the police officer's head, detectives said.

A second officer arrived and the suspect threw another piece of jagged concrete at him, police said.

Detectives said that after refusing to put down his makeshift weapons, one of the officers shot the man three times.

Phillips was taken to Ben Taub Hospital and was out of surgery and in critical condition Tuesday afternoon.
