A Harris County deputy constable was suspended from duty after being charged with driving drunk with his 4-year-old son in the car with him, Local 2 Investigates reported on Friday.
Precinct 3 deputy Henry Ervin Williams, 34, who has patrolled northeast Harris County neighborhoods for the past three years, was booked on a felony charge of driving while intoxicated with a child passenger.
Harris County sheriff's deputies said they got a call around 4:30 pm. Thursday that a man was passed out behind the wheel on the roadside off Stonefield Manor and C. E. King Parkway.
Deputies said they arrived to find the engine running, but they were unable to get a response from the driver.
After knocking on the glass with their flashlights, deputies finally got the attention of Williams, who was in his personal car and off duty.
The 4-year-old child was in the passenger seat, according to the police report.
Paramedics were called because deputies were unsure whether he was unconscious from a medical condition, but blood was drawn after he was taken to the hospital and deputies said he was over the legal limit for being behind the wheel.
The exact amount of alcohol detected in his blood was not known on Friday afternoon, according to deputies and prosecutors.
The deputy's boss, Precinct 3 Constable Ken Jones, told Local 2 Investigates that he suspended Williams without pay after he was booked. The deputy is being given the option of using vacation time for the initial part of his suspension, but Jones said he will fire Williams if he is found guilty of the crime.
"I have to, by my policy," said Jones.
The constable described Williams as an "exemplary officer" and added that he has "perfect marks all the way down."
Williams posted a $10,000 bail and was released from the Harris County Jail. He is scheduled to face a judge in the 230th District felony court of Harris County on Monday.
The deputy did not yet have an attorney listed in his court file and he could not be reached for comment. No one answered the door at his home in northeast Harris County.
