Girl, 13, Shot To Death Outside Home
Relative Believes Brother, 16, Pulled Trigger

LIVINGSTON, Texas -- A 13-year-old girl was shot to death outside her Polk County home and a relative believes the girl's brother pulled the trigger, Local 2 reported Monday.
The Polk County Sheriff's Department said the girl was shot in the face outside the family's mobile home just after midnight Sunday morning.
Officials do not know if the shooting was accidental or intentional.
"We had a very unfortunate death here in our community where a youth lost her life. Details are still sketchy and the investigation is continuing," said detective Dennis Allen, with the Polk County Sheriff's Department.
A relative of the teenagers, who did not want to be identified, said she believes the victim's brother pulled the trigger.
"She was scared of her brother. She was scared," she said.
The relative said she called Child Protective Services several times trying to get the girl out of what she called "a dangerous situation."
"Guns (were) lying around different places in the house. The dad thought it was OK. I'm frustrated. I'm very frustrated because no one would listen. No one listened. No one did anything," the relative said.
Allen said the sheriff's department is looking into the relative's allegations.
"One of the things is the use of a firearm being readily accessible to the youths. We're trying to determine if the gun was put away at some particular point and how accessible it was to the children," Allen said.
CPS officials told Local 2 that they are also researching the case.
No charges have been filed. The case will be referred to the District Attorney's Office.
The victim's name was not released.
