Verdict Reached In Cell Phone Trial

Jeri Montgomery Guilty Of Negligent Homicide

Jurors have reached a verdict Friday the case of a woman accused of causing a fatal crash because she was on her cell phone, KPRC Local 2 reported.

The jury found Jeri Montgomery guilty of negligent homicide.

Prosecutors said Montgomery, 24, caused a three-car wreck on Interstate 45 near F.M. 2920 that killed Chance Wilcox, 25, on March 24, 2008.

Prosecutors said cell phone records showed Montgomery was on a call during the wreck.

Montgomery appeared nervous as she took the stand in her defense. She testified that she put the phone in the passenger seat before changing lanes and admitted that being on the phone on her way to her boyfriend's house distracted her from her route.

"It did justice, though people watching the cell phone's, not watching what they're doing," said Wilcox's father, Butch. "It was terrible but maybe this will help."

The person Montgomery was talking to around the time of the wreck told the jury that their call was disconnected, but it was unclear whether the dropped call happened because of the accident or extenuating circumstances.

""I love him very much and I miss him," Wilcox said. "Can't bring him back though."

Montgomery faces two to 10 years behind bars. The punishment phase of the trial began immediately after the verdict was handed down.
