According to investigators, the officers saw a robbery going on in the parking lot.

The robbery suspect, 24-year-old Mario Eddie Torres, took off on foot, police say.

When one of the officers approached the dark Cadillac sedan Torres had been in, they say he saw the driver had a gun.

The driver, identified as 23-year-old Nectaly Castillo, started to drive away, stopped the vehicle and fired a single shot at the officers, police say.

One of the officers, fearing for his safety and that of his partner, also fired a single shot with his duty weapon, forcing Castillo to flee the scene.

Both men were arrested by HPD officers a short distance away.

No one was hurt during the shooting.

Castillo is charged with aggravated assault against a public servant.

Torres is charged with robbery causing bodily injury.

Because an officer fired his duty weapon, the case will be investigated by the HPD Homicide and Internal Affairs Divisions.
