Report Not Filed After Car Hits Boy

Boy, 4, Spends 9 Days In Hospital

A 4-year-old Montgomery County boy was hit by a car and spent nine days in a hospital, but an accident report was never filed in the case, KPRC Local 2 reported Tuesday.

Hunter Hayes was on a skateboard in front of his house when he was hit by a neighbor's car on Legends Mist at Avera Creek in the Legends Ranch subdivision, his mother said.

He was taken to Texas Children's Hospital with a ruptured spleen, broken shoulder blade, fractured collar bone and a hole in his neck.

Hunter's mother still relives the trauma.

"I remember everything from that day -- when I go to sleep at night, that scenario goes over and over in my head," Audrey Hayes said.

When she called the Montgomery County Sheriff's Office looking for an accident report and to see if the driver would be held responsible, she was told nothing was reported.

"There was no number. There was no record. It was like it had never even happened," Audrey Hayes said.

Hunter's family members said they wondered how a driver could nearly kill a child, but a report was not filed.

The Montgomery County Sheriff's Office said three deputies responded to the scene, took statements and pictures, but never filed a report.

"This is not typical. We probably dropped the ball a little bit. But we want to move forward and get going on this," said Dan Norris with the Montgomery County Sheriff's Office.

Officials said investigators will go to the Hayes home on Wednesday to finish the report.

The district attorney will then review it and determine if charges should be filed.

Hunter has had cosmetic surgery for his facial scars. He is still not well enough to go to school, but is recovering.

Doctors said only time will tell if injuries in his neck area will prevent him from playing sports.
