Man Claims HPD Officers Put Him In ICU

POSTED: Wednesday, November 19, 2008
UPDATED: 5:30 pm CST November 19, 2008

The family of a Houston-area man said he was nearly beaten to death by Houston police officers when he was stopped on traffic warrants, KPRC Local 2 reported Wednesday.

Marvin Driver Jr. said he and his brother had just finished moving furniture when he pulled into the driveway of his mother's home in southeast Houston in the 8300 block of Gibbons shortly before 2 a.m. on Monday.

They said an officer came up behind their pickup truck and a confrontation occurred. Driver was arrested.

"I could tell by the way the police officer was grabbing him, pulling him and snatching him that he was in trouble," brother Winston Driver said.

Marvin Driver is now in Memorial Hermann Hospital's intensive care unit.

"Angry -- that's all I have is just anger. I want justice to be served and that's all I ask for -- justice to be served and these officers to be taken off the streets," son Michael Driver said.

Community activist Quanell X showed reporters paper towels Marvin Driver wrote on from his hospital bed, telling his loved ones what he said happened to him while in police custody.

"They picked him up and took him behind a Valero station by a dark road, where he was beaten and forced to swallow something. What they gave him to swallow, he said that they made the statement that he was going to see Jesus. Told him to 'Swallow this. You're going to see Jesus,'" Quanell X said.

Marvin Driver is the father of Green Bay Packers wide receiver Donald Driver.

Marvin Driver told family members that he knew one of the officers personally and that disparaging comments were made about his son.

The Houston Police Department released the following statement.

"Mr. Marvin Driver Jr. was arrested during a traffic stop and placed into custody on outstanding traffic warrants about 1:30 am on Monday (Nov 17). Officers placed him in the back seat of a patrol unit and transported him to our Southeast Jail at 8300 Mykawa Road. Upon arrival to the jail, our officers stated Mr. Driver was unresponsive. One of our jail doctors examined Mr. Driver and advised officers to contact HFD paramedics. HFD then transported Mr. Driver to Memorial Hermann Hospital.

"The Houston Police Department's Internal Affairs Division investigates allegations of police misconduct. The allegations being raised by Mr. Driver's family are that injuries he sustained following his arrest were the result of an assault on Mr. Driver by two HPD officers.

"We take allegations such as these very seriously and will begin a thorough investigation into the matter. The two officers remain on duty pending further investigation."

Donald Driver graduated from Milby High School and was drafted by the Packers in 1999.

Packers coach Mike McCarthy said that Donald Driver has been excused from practice but that the wide receiver is expected to play Monday night.

Donald Driver was on his way to Houston to visit his father.

The pickup truck his father was driving on the night of his arrest came from Donald Driver's Chevrolet dealership in Milwaukee.
