Teen Charged With Newborn's Death In School Bathroom

A 14-year-old girl has been arrested and charged after her newborn was submerged in a school toilet, officials told KPRC Local 2 Thursday.

Baytown police Capt. Roger Clifford said the girl, who was not identified because she is a juvenile, was charged with capital murder.

Investigators said the 5-pound, 6-ounce boy died April 2 in a restroom at Cedar Bayou Junior School, located at 2600 Elvinta. The baby had toilet paper stuffed in his throat, and suffered blunt trauma to his head and neck, according to an autopsy.

Officials said the baby boy was alive and was drowned in the toilet. The medical examiner said the newborn died of water submersion and internal airway obstruction.

"Because of the outcome, it is disturbing. It is, in many ways, a terrible time in the lives for both the mother of the baby and for the family members and for all that are involved," Clifford said. "We had enough evidence to believe that this act was done intentionally and knowingly."

Gerald Yoakum, the girl's attorney, said that the eighth-grader did not realize she was pregnant or that she gave birth.

He issued the following statement.

"The current taking into custody of the juvenile is part of the process dictated by the Texas Family Code. In the next few weeks and months, and only after a complete investigation, we are sure that all the facts, and only the facts, not opinions and speculations will control this case. We will be working with the Harris County District Attorney's office and the juvenile court system to resolve this matter. Please remember that this is a 14-year-old child who has experienced a tragic event," Yoakum said.

The baby's death has been ruled a homicide. The teenager could be certified to stand trial as an adult.

"The district attorney's office has concluded that there is probable cause to believe that the 14-year-old mother intentionally and knowingly caused the death of her newborn child," Clifford said.

The mother's pregnancy was in its 35th to 36th week when the baby was born.

The Goose Creek Independent School District said there are options for pregnant teenagers.

"My message would be that there are other ways to handle this and to please tell someone. Contact an adult so that they can help you. And to parents -- it would be to keep the lines of communication open," spokeswoman Kathy Clausen said.

Baytown is about 25 miles east of Houston.
