Police Investigate Student-On-Student Attack Allegation

Houston police are investigating accusations of a sexual assault at a northeast Houston high school, KPRC Local 2 reported Wednesday.

Parents said a student at Kashmere High School, located at 6900 Wileyvale, attacked their special-needs teenager.

"This should not happen. This is a special needs child," said the sister, whose identity was not released.

The sister said that her 16-year-old brother, who has Downs syndrome, was sexually assaulted by another special-needs student on Friday in a school bathroom.

She said he has not been the same since.

"He is saying that he's hurting. 'Mom, such-and-such person has hurt me,'" the sister said.

School officials said Houston Independent School District police conducted an investigation, but the district attorney's office declined to accept charges.

Police said that's because both boys have extremely limited verbal skills and they have not been able to determine exactly what happened.

"We're upset and angry that some serious mistakes were made here at Kashmere High School," said Quanell X, with the New Black Panther Nation.

It appears school policy was broken. School officials said a female teacher escorted the male student to the restroom. Besides that, the principal said she wasn't informed of the incident until three days later.

In a written statement, the principal said she would take appropriate action in the failure to notify her.

"She apologized for not contacting the family sooner. She apologized for allowing (the boy) to go home but not being seen by a nurse," Quanell X said.

Family members said it was a little late for apologies despite the fact that the student who allegedly committed the assault has been suspended and will be removed from class.

"He could do this to somebody else's child, people. He could do this to somebody else's child," the sister said.

HPD has contacted both of the students and said even though the district attorney's office declined charges, that could change. It depends on how well the two boys are able to communicate about what happened that day.

School officials said they would assign a personal male aid to the alleged victim, who will be reassigned to another classroom and possibly to another school.

HISD will also provide psychological counseling for that student.

Statement from Dr. Charlotte Parker, principal of Kashmere High School

"On Friday, Feb. 23, two male special education students were in a restroom together at Kashmere High School. A teacher found them there undressed and it appeared that one student may have been attempting sexual contact with the other student.

"Both of the 16-year-old students have been in the same special needs program for several years. Both students have limited communication skills.

"School officials immediately attempted to contact the parents of both children. One of the children’s parents could not be reached by phone, so two teachers from the school followed the young man’s school bus home and personally reported the incident to the mother.

"HISD Police investigated the case and contacted the district attorney’s office. The district attorney’s office declined to accept charges in the case because of the special needs status of the persons involved.

"I was not notified of this matter by the assistant principal until Monday, February 26. I will take appropriate disciplinary action in regard to that failure to notify me.

"Our protocol is that when children in this classroom are involved, only one child is allowed to go into the restroom at a time. In this case the other child was able to get in without being detected.

"We will assign a personal male aide to that child and reassign him to another classroom or to another school. We also will provide psychological and counseling services to the student.

"The student who was seen possibly attempting the sexual contact was suspended. He will be assigned to a different classroom location and then will be reassigned to a separate school."
